Frequently Asked Questions By Clients Facing Charges in Edison New Jersey

Edison Municipal Court

Where will my Edison traffic offense or criminal charge be heard?

The Edison Municipal Court has limited jurisdiction to handle ordinance violations, traffic tickets and misdemeanor criminal charges that are called disorderly persons offenses under New Jersey Law. If you are facing an offense falling in one of these categories, it will be heard in the Municipal Court of Edison. Conversely, an offense that is indictable, meaning that it is a crime of the first degree, second degree, third degree or fourth degree, falls under the authority of the Middlesex County Superior Court in New Brunswick. Your case will be transferred to the county courthouse if it is of this nature. You should also know that restraining order hearings can only be heard at the Superior Court except that they are dealt with in the Family Division.

Should I plead guilty or not guilty to the Edison charge I am facing?

You may plead guilty, not guilty or guilty with an explanation. It is always recommended that you speak to a lawyer about the penalties that you are facing and options in terms of defending the charge.

Who will decide whether I am innocent or guilty of the Edison offense that was charged?

All municipal court cases, including DWI, are decided by a single person, the Edison Municipal Court judge presiding over your case. Charges that are indictable carry with them the right to a trial by jury. If your Edison criminal offense involves burglary, aggravated assault or another indictable crime, you will have this right.

Do I need an attorney when I appear in Edison Municipal Court?

You have the right to be represented by an attorney of your choosing but I not required to hire a lawyer. If you are indigent and do not have the money to retain a defense attorney, the court will appoint you a public defender. There are strict income guidelines for qualifying for a public defender, for example, single person with no dependents must make $15,075 or less to qualify. You are encouraged to contact one of our lawyers for a free consultation about what can be accomplished on your behalf.

What penalties do I face if I am convicted of criminal or motor vehicle charges in Edison?

The penalties for a criminal offense hinge on the degree of the charge. A disorderly persons offense typically carries a fine of up to $1,000 and up to 6 months in the Middlesex County Jail. Indictable violations carry the following standard penalties: up to a $10,000 fine and 18 months in prison for a fourth degree crime; up to a $15,000 fine and 5 years in prison for a third degree crime; up to a $150,000 fine and 5-10 years in prison for a second degree crime; and up to a $250,000 fine and 10-20 years in prison for a first degree crime.

How will my criminal charge be handled if its a crime of the first, second, third or fourth degree?

A crime of the 1st, 2nd, 3rd or 4th degree is always indictable so it must be dealt with at the Superior Court in New Brunswick. You will not typically be required to appear in Edison Municipal Court because charges of this nature fall outside local jurisdiction. An initial appearance at the county level is provided, in most cases, at the time of processing or in the nail shortly thereafter. All proceedings that are thereafter conducted shall be at the county courthouse.

Will I have a criminal record if I am convicted of an offense in Edison?

You will absolutely have a criminal record if you are convicted of an Edison disorderly persons offense or first-fourth degree crime. Any entity that conducts a background check following conviction will see that you have this violation on your record and may make his/her decision regarding employment, issuance of a professional license or any other determination with this information effecting their determination.

Arrested for a First, Second, Third or Fourth Degree Crime in Edison Township

Although Edison Township would not be described as a high crime community, over one thousand individuals are arrested for indictable charges of the first, second, third and fourth degree almost every year. These offenses include not only the extreme like robbery and sexual assault but also fourth degree aggravated assault and third degree shoplifting in Edison. The municipal court in Edison lacks jurisdiction to preside over cases falling within this grading since you have a right to presentation of the charge to a grand jury which can only be empaneled at the Middlesex County Superior Court. The result is that all proceedings in an indictable crime case, with the possible exception of an initial arraignment, must occur at the county courthouse in New Brunswick NJ.
