Plainsboro, NJ Criminal Charges: Underage Possession of Alcohol
An example of one of the offenses our criminal defense lawyers frequently face in Plainsboro is underage possession of alcohol under N.J.S.A. 2C:33-15. The typical scenarios where this charge arises is where the Plainsboro Police break up a party and encounter underage drinking, or where they stop a motor vehicle and discover alcohol possessed by someone who is under legal drinking age. While 2C:33-15 might appear to present a minor infraction, this is not an accurate assessment as a conviction can have a serious impact on a young person and their future as it results in a criminal record. Moreover, the maximum penalty for a disorderly persons offense is six (6) months in prison. Remember, the legal limit in New Jersey is .08% BAC for adults but for individuals under legal age the legal limit is .00% BAC. As a result, if the underage defendant’s breathalyzer readings are .01% or higher, the defendant will also be charged with Underage Driving While Intoxicated (DWI) in New Jersey. However, if the underage defendant’s readings are .08% or higher, they will also be charged with adult driving while intoxicated (DWI).
