The Municipal Court of North Brunswick has jurisdiction to preside over misdemeanor criminal charges like a disorderly persons offense for simple assault. The municipal court is located at 710 Herman Road, North Brunswick, New Jersey, and it can be reached at 732-247-0922. Elements for Proving Simple. The standard of proof is beyond reasonable doubt should your simple assault proceed to trial. In order to prove you guilty in accordance with N.J.S.A. 2C:12-1, the state must establish that you engaged in one of the following with respect to another person: (1) attempted to cause bodily injury; (2) purposely, knowingly or reckless caused bodily injury; (3) negligently cause bodily injury with a deadly weapon; or (4) physically menacing conduct to create fear of imminent serious bodily injury.

Penalties If Convicted of Simple Assault. There are a wide range of penalties that may be imposed under N.J.S.A. 2C:12-1 if you are found guilty of simple assault. The maximum fine is $1,000. The court may also order a period of community service and/or probation. The most serious potential consequences is up to six months in the county jail.

Conditional Dismissal. First time offenders may apply for diversion from prosecution under the conditional dismissal program. There is typically a one year period of probation that must be fulfilled as a prerequisite to completion of this program.
