Adderall Offense in Middlesex County

N.J.S.A. 2C:35-10.5 targets those who possess prescription drugs like Adderall without a valid prescription. The law also applies to those who distribute this CDS without a license. Either variety of violation arises as follows:

  • Second Degree Crime. It is a second degree crime to possess or distribute 100 dosage units or more of Adderall. There is a maximum fine of $300,000 and up to 5-10 years in state prison that applies at the time of sentencing.
  • Third Degree Crime. Possessing or distributing at least 5 dosage units but less than 100 is a third degree crime that results in a fine of up to $200,000 and as much as 5 years in prison.
  • Fourth Degree Crime. A fourth degree crime with up to 18 months of incarceration and a $10,000 fine is triggered if someone is convicted of possession or distribution of four or fewer dosage units of Adderall for pecuniary gain.
  • Disorderly Persons Offense. A person who distributes four or fewer units of Adderall without pecuniary gain is guilty of a disorderly persons offense. The penalties for this violation include up to 6 months in the county jail and a fine of up to $1,000.
  • Drivers License Suspension. There is a mandatory driver’s license suspension that also applies when someone is convicted of a violating 2C:35-10.5. The period of revocation ranges from 6 months to 2 years in the discretion of the court.
