Traffic Offense in Metuchen New Jersey

The law says your driver’s license is a privilege and not a right, so the state can impose conditions to operation of a motor vehicle. Driving within the speed limit, obeying traffic safety devices (e.g. stop sign, light, etc.), maintaining car insurance and not operating carelessly or recklessly are requirements by law. Failure to adhere to these and other regulations can result in a traffic offense that carries motor vehicle points, fines, suspension and even jail in extreme cases.

The New Jersey Motor Vehicle Commission is required to track motor vehicle convictions for drivers licensed in this state. Every time a motorist is convicted of a moving violation, points are assigned to their license. Speeding, reckless driving and improper passing are examples of a few of the many moving violations of this nature. If you are found guilty of a traffic offense in Metuchen Municipal Court, you will have the following points assigned:

  • N.J.S.A. 39:4-85 – Improper passing – 4 points

  • N.J.S.A. 39:4-96 – Reckless driving – 5 points

  • N.J.S.A. 39:4-89 – Tailgating – 5 points

  • N.J.S.A. 39:4-91 – Failing to yield to emergency vehicles – 2 points

  • N.J.S.A. 39:4-105 – Failing to stop for traffic light – 2 points

  • N.J.S.A. 39:4-97 – Careless driving – 2 points
  • N.J.S.A. 39:4-98 – Speeding:

    • Up to 14 mph over the speed limit – 2 points
    • 15-29 mph over the limit – 4 points

When you accumulate six or more points during a three-year period, you must pay a $150 surcharge to the state and an additional $25 for each point in excess of six.
