This law sets forth five (5) varieties of shoplifting: (1) taking merchandise with the intention of depriving the merchant of the item; (2) purposely concealing goods; (3) altering or transferring a price tag; (4) transferring merchandise to a container; and (5) underringing a sale. If the prosecutor establishes that, beyond reasonable doubt, you committed one of these 5 acts, you may be convicted of the criminal offense set forth under N.J.S.A. 2C:20-11.

Penalties If Convicted of Shoplifting

If a shoplifting case is being heard in Edison Municipal Court, the offense is what is commonly referred to as a disorderly persons offense. A fine of up to $1,000 may be imposed, along with mandatory court assessments and costs. A jail term that can reach six (6) months also applies and ninety (90) days is mandatory for anyone convicted of a third or subsequent offense. Ten (10) days of community must be performed for a first offense, 15 days for a second offense, and 25 days for a third offense. More serious shoplifting charges arise in Edison, which are referred to as indictable crimes (i.e. Fourth Degree, Third Degree & Second Degree), are heard at the Middlesex County Superior Court.
