Marijuana Distribution Offense in Woodbridge New Jersey
Woodbridge historically ranks one or two in the county in terms of population so it makes sense that the incident of a marijuana distribution offense is higher in the municipality than most. The fact that a considerable portion of the Garden State Parkway, including the Thomas Edison Service Area, is located within the township only adds to the volume of marijuana charges. For those facing a violation under N.J.S.A. 2C:35-5 (“Manufacturing, distributing or dispensing”) anywhere in the state, the consequences of a conviction are predicated on the quantity being sold or possessed with intent to distribute. Distributing twenty-five pounds or more of marijuana or possessing it with the intention of doing so, is a first degree crime. Distribution of at least five pounds but less than twenty-five pounds is a second degree crime. When someone sells or distributes at least one ounce but less than five pounds of marijuana, they face a third degree crime. Possession with intent to distribute less than one ounce of marijuana is a fourth degree crime. The following chart outlines the penalties that apply for each of these grades of marijuana distribution offenses.
Grade of Offense | Period of Incarceration | Maximum Fine |
First Degree | 10-20 Years | $300,000 |
Second Degree | 5-10 Years | $150,000 |
Third Degree | 3-5 Years | $25,000 |
Fourth Degree | Up to 18 months | $10,000 |

This area is referred to as a drug free school zone. For additional information on this subject, you can refer to our page for distribution in a school zone.
