Charged With Possession of Prescription Drugs Under N.J.S.A. 2C:35-10.5
N.J.S.A. 2C:35-10.5 makes it a crime to possess or distribute a prescription legend drug except if you are qualified to do so by law. Prescription legend drug is defined as “any drug which under Federal or State law requires dispensing by prescription or order of a licensed physician, veterinarian or dentist and is required to bear the statement Rx only or a similar warning”. The penalties for violating this statute hinge on the quantity involved. It is a fourth degree degree crime to possess four or fewer pills or dosages. Possessing at least 5 dosage units (e.g. pills) but less than 100 is a third degree crime. It is a second degree crime to be in possession of 100 or more dosage units of a prescription legend drug. All of these grades involve indictable crimes which are felony in nature.
Fourth degree prescription drug possession results in a fine of up to $10,000 and the possibility of a state prison sentence of 18 months. Third degree possession carries penalties that include a maximum fine of $200,000 and a period of incarceration that can reach 5 years. A fine of up to $300,000 and 5-10 years in prison apply in the event of conviction for second degree possession of a prescription legend drug. There is also a 6-24 month suspension of a defendant’s driver’s license if the are found guilty of CDS possession in any form.
